no-fault insurance, type of indemnity plan, usually applied to automobile coverage, in which those injured in an accident receive direct payment from the company with which they themselves are insured.
Originated (1947) in Saskatchewan, Canada, no-fault insurance eliminates the need for accident victims to establish another's liability, or fault, through a civil lawsuit. Lawyers' groups oppose no-fault, saying that it limits the citizen's right to sue.
Supporters say that it leads to quicker settlement of accident claims and lower premium rates than the traditional tort liability system because it reduces legal fees and court costs. The first comprehensive no-fault plan in the United States was adopted (1971) in Massachusetts. Currently 13 states have no-fault auto insurance laws that in some way restrict the right of parties to file legal suits.
Provisions defining when a person can sue in no-fault states vary, but motorists can generally sue for severe injuries. Recently, however, rising insurance costs have led some states to reexamine the effectiveness of no-fault insurance laws
No fault insurance
No fault insurance is a type of automobile insurance where an insured need only prove that they were injured in an automobile accident (either damage to persons or damage to property) to recover under the policy. There is no need for them to prove that they were not at fault in the accident, or to prove another party was at fault in the accident. Many U.S. states and Canadian provinces operate under a "no fault" scheme where persons injured in automobile accidents are not allowed to sue other drivers or vehicle owners involved in an accident unless their injuries are particularly severe. No fault insurance is only available in jurisdictions which have a no fault scheme.
No fault insurance has the benefit of avoiding litigation over the cause of the accident, which historically has been difficult to prove due to conflicting evidence and eyewitness accounts. However, critics of no fault point out that it does not punish reckless or negligent drivers in litigation, and that it is particularly difficult to sue if a person's injuries leave them with a handicap.

Lauderdale based attorney John Hargrove and the firm of Gordon, Hargrove and James alleging malicious prosecution and other claims for relief. Phillip Wasserman and Phillip Roy Financial Services allege that Hargrove and his firm engaged in a scheme to defraud the courts by alleging that multi-millionaire retirees are not of sound mind to purchase annuities but yet are of sound mind to contract with them as attorneys. Wasserman and his firm also allege that Hargrove and his firm have filed dozens of similar cases in Florida courts as part of an overall scheme of coercion and have misrepresented their clients' mental health in order to recover attorney's fees.
